Terms & Condition for rental properties

In all cases an Application Form must be completed in order to obtain three substantial references, ie Bank, Employers and previous landlord.  Where 2 or more people are renting, they become jointly and severally liable for the whole of the rent.  Therefore, references for individuals will be based on the quoted rental.

There is a minimum returnable deposit of £750 but this amount may vary according to the instructions from the Landlord.

All rents are paid Calendar Monthly and the first month`s rent is paid in advance.

No animals can be considered in the majority of cases.

Tenant meet the full accounts for:  gas, electricity, telephone charges, water rates, council tax, television license in both furnished and unfurnished properties.

Tenants receiving Housing Benefit or Rent Allowance from the Local Authority can only be considered if they are still able to provide us with full references, as above.  The exception being if Adur District Council are prepared to place the Tenancy in their name.  Furthermore, Government Legislation enforces that Local Authorities will pay rent one month in arrears.  Adur Council will  not be paying rent when the actual tenancy commences, so all tenants must therefore find the initial month`s rent before they take possession.

Due to new legislation, no single persons under the age of 25 can be considered at all who are in receipt of Housing Benefit or any payment from Social Security.

In the majority of cases, Landlords will not consider Multiple Lets, Students or smokers.

During the letting period neither party can give any Notice to terminate the Tenancy is 6 or 12 months unless a "get out" clause is added.

PROPERTY ASSESSMENT: 

Mr R J Brown will, under no obligation, inspect and     assess the property and advise on the monthly rental value.

LISTING: 

The property is entered on our current list, the Internet and circulated to possible listed tenants and local business concerns, i.e. local Health Authority, Schools, Health Centres etc.

INVENTORY: 

For furnished lettings, preferably, the Landlord should prepare a full Inventory of items remaining at the property and a copy given to R J Brown & Co.  A copy is then given to the tenant to check, sign and return to our office on taking possession. We would of course, prepare the Inventory if required and the cost would be dependent upon the time taken to attend to it.

ANIMALS: 

No animals are generally allowed, unless Landlords advise us otherwise.

TENANTS: 

A prospective Tenant completes an Application Form from which 3/4 references are applied for i.e. present Landlord, Employers, Bank or Building Society, Accountant or possibly independent professional.

TENANCY AGREEMENTS ETC: 

On receipt of 3 satisfactory references, Assured Shorthold Tenancy Agreements  are prepared and signed by both Parties before the Tenancy commences

LANDLORDS: 

Those persons having a Building Society Mortgage or a mortgage from another source should obtain written permission from the Mortgagor to let the property.

DEPOSIT: 

This Deposit has to be registered under the Government’s Tenancy Deposit Scheme and this is guaranteed by way of an Insurance Policy which we have to take out.  This also entails us providing to the tenant a list of any contents, landlord’s fixtures and fittings and the state and condition of the property.

RENTAL EXCLUSIONS: 

The rental charged excludes:  Council Tax, Gas, Electricity, Water Rates and Telephone accounts and for which the tenants are liable.

SERVICING OF GAS APPLIANCES:

It is Law that Landlords must have gas appliances serviced annually and a Gas Safety Certificate issued.  This servicing is to include gas boilers, gas fires, gas cookers, radiators and pipework and any other gas appliances.  The work must be undertaken by an approved Registered Heating Engineer and we have 2-3 local engineers we use if required.

ELECTRICAL SAFETY CERTIFICATE:  

It is law that the electrical installations in rented properties are inspected and tested by a qualified and competent person at least every 5 years.

ENERGY PERMORMANCE CERTIFICATE:  

It is law that every let property has to have an inspection which will be followed by this Certificate which gives an indication of the energy running costs and details of the insulation or lack thereof.

PAYMENT OF RENT

Most rents are paid calendar monthly in advance from the date the tenants take possession.

CHARGES: 

Our fees are 12% of each month’s rent received including VAT and we submit a monthly Statement to you.  The balance of rent can be paid into your bank or building society account.  There are special conditions made by the Inland Revenue for Landlords who reside overseas.

KEYS: 

Ideally R J Brown & Co should hold 3 sets to the property, 2 for the ingoing tenants and 1 set to be kept at our office for emergencies.

GENERAL REMARKS: 

We strongly recommend Landlords confirm to their Insurance Companies (both for the property and its contents) that the premises are to be occupied by persons other than the insured.  Furthermore that they are aware tenants will be making use of the contents where applicable.
